According to a filing in the U.S. District Court of the Western District of Louisiana, Banc of America Leasing & Capital filed a complaint against Broussard, LA-based Breakwater Advanced Manufacturing, Bryan Benoit, Greg David and Mark Leach alleging that the borrower and guarantors failed to perform their contractual obligations.
According to the complaint, Banc of America Leasing alleges that the defendants purchased MAZAK machine tool equipment and were granted loans. As of January 11, 2017, the outstanding amount owed exceeds $541,000 excluding attorney fees and litigation expenses.
The plaintiff holds Breakwater Advanced Manufacturing, Benoit, David and Leach responsible because the defendant allegedly failed pay the monthly installments.
The complaint notes that the plaintiff is requesting a trial by jury and seeks judgment against defendants for the full amount of the outstanding obligation, attorney’s fees, costs and expenses and any additional relief that the court may deem appropriate.
Banc of America Leasing & Capital is represented by J. Dalton Courson of Stone Pigman Walther Wittmann, according to the filing.
