Priority Capital Leasing Sued for Breach of Contract



According to a documents filed in the U.S. District Court for Eastern Pennsylvania, Gary Bacher, an independent broker operating out of an office in Allentown, PA, filed a complaint against Melrose, MA-based Priority Capital Leasing for declaratory judgement of the unenforceability of a non-competition agreement and breach of contract which deprived him of roughly $800,000 in commission income.

In the complaint, Bacher alleges that Priority Capital Leasing required him to sign a contractor confidentiality and non-competition agreement under threat of loss of roughly $100,000 in commissions. Bacher further alleges that Priority engaged in practices to interfere with his existing and future business, causing him to lose out on deals and potential commissions.

Bacher requested a trial by jury seeking a declaration that the non-competition agreement is null and void as well as the awarding of damages from the breach of contract and associate court costs.
